# Can you apply for Spain’s digital nomad residence from inside Spain on a tourist stay?

Yes. Article 74 quinquies of Law 14/2013 lets foreign nationals who are in Spain lawfully apply to UGE-CE for the digital nomad residence permit, and that includes a visa-free stay or a valid Schengen visa. You must apply before your authorised stay ends. Filing extends your current stay until UGE decides (article 76.1). Spain Visa Submit files ready applications from Spain for €80 per applicant.

## What the law says

Article 74 quinquies.1 of Law 14/2013 says that foreign nationals “que se hallen en España de forma regular” (who are in Spain lawfully) may apply for a residence authorisation to telework for a company located abroad. The Spanish consulate in Washington explains that this includes people staying without a visa, for example for 90 days in any 180-day period, and people on any valid visa, including a tourist visa. UGE’s FAQ adds the reverse rule: this residence authorisation cannot be requested from abroad. From outside Spain you apply for a visa at a consulate instead.

## Apply before your stay ends

Article 62.3.a requires that you are not in Spain irregularly, and Plataforma ONE says this must be met “en el momento de la solicitud”, on the day you apply. A visa-free stay lasts up to 90 days in any 180-day period (Organic Law 4/2000, article 30), and a visa stay lasts while the visa is valid. The date that counts is the filing date on the official UGE receipt, not the day you uploaded documents or paid.

## Your stay while UGE decides

Article 76.1 of Law 14/2013 says the application “prorrogará la vigencia de la situación de residencia o de estancia de la que fuera titular el solicitante hasta la resolución del procedimiento”: it extends your existing stay until the procedure is decided. Keep the official filing receipt as proof of the filing date. We found no official guidance on travelling outside Spain while the application is pending, so ask a qualified adviser before you book a trip.

## Criminal records on a short stay

Plataforma ONE says that if you are in Spain on a stay (estancia) or a study stay of under six months, you must provide an original criminal record certificate from the countries where you lived in the last five years. UGE’s own document list asks for certificates covering the last two years plus a sworn declaration covering five years. Check the current UGE list for your case.

## Rumours about tourist entries

In 2026 some blogs claimed that UGE no longer accepts applicants who entered as tourists. As of 2 November 2026 no official source supports this. Article 74 quinquies is unchanged, and Plataforma ONE and UGE still describe the procedure for people who are in Spain lawfully.

## Filing from Spain without a digital certificate

Spain Visa Submit files ready applications with UGE-CE using our own digital certificate and your signed authorization, for €80 per applicant. We do not assess whether you qualify or whether your stay dates comply.

## Frequently asked questions

### Can I apply for the digital nomad residence on a visa-free stay?

Yes, while that stay is still valid. Article 74 quinquies.1 of Law 14/2013 covers anyone in Spain lawfully, and a Spanish consulate confirms this includes visa-free stays and tourist visas.

### What happens if my 90 days end while UGE is deciding?

Article 76.1 of Law 14/2013 says that filing extends your existing stay until UGE decides. The application has to be filed before the stay ends.

### Can I apply after my stay has expired?

Not under this procedure. The law requires that you are not in Spain irregularly, and Plataforma ONE says this is checked on the day you apply.

### Can I travel while my application is pending?

No official source answers this. Ask a qualified immigration adviser before you travel.

### Can Spain Visa Submit file my application while I am in Spain?

Yes. Spain Visa Submit files prepared applications with UGE-CE for €80 per applicant, using our own digital certificate under your authorization.
